Terms of Use

1. Acceptance of Terms

By accessing or using AvianDB (the "Service"), you agree to be bound by these Terms of Use ("Terms"). The Service is operated by AllBreed Solutions ("Company," "we," "us," or "our"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

AvianDB is a record-keeping application for domesticated birds. You create one or more bird databases — each locked to a single species category — and maintain a private registry of the individual birds you keep. Your records are private to your account and are not published or shared with other users by default.

3. Eligibility

You must be at least 18 years old and capable of forming a legally binding contract to use the Service. By creating an account, you represent that you meet these requirements.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information when registering and to keep it current. You may not transfer your account to another person.

5. Your Content and Data

You retain ownership of the records, descriptions, and other data you enter into the Service ("Your Content"). You grant us a non-exclusive, royalty-free license to store, process, and display Your Content solely to operate and provide the Service to you. You are solely responsible for the accuracy and legality of Your Content, and for keeping your own copies of any data that is important to you.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
• Attempt to gain unauthorized access to the Service, other accounts, or our systems.
• Scrape, harvest, or otherwise extract data from the Service by automated means without our permission.
• Interfere with or disrupt the integrity or performance of the Service.
• Upload content that is unlawful, infringing, or that you do not have the right to submit.

Violations may result in suspension or permanent termination of your account at our sole discretion.

7. Fees

AvianDB is currently offered free of charge. We may introduce paid plans or features in the future. If we do, any applicable fees will be disclosed to you before you are charged, and your continued use of a paid feature will be subject to those terms.

8. Intellectual Property

All Service content, branding, and software are the property of AllBreed Solutions or its licensors. Except for the rights expressly granted to you, these Terms do not grant you any right, title, or interest in the Service. You retain ownership of Your Content as described in Section 5.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, secure, or free of data loss. You are responsible for maintaining your own backups of any records that are important to you.

10. Limitation of Liability

To the maximum extent permitted by law, AllBreed Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising from your use of the Service. Our total liability to you for any claim shall not exceed the greater of the fees you paid to us in the twelve months preceding the claim or fifty U.S. dollars ($50).

11. Indemnification

You agree to indemnify and hold AllBreed Solutions and its officers, directors, and employees harmless from any claims, damages, or expenses (including reasonable attorneys' fees) arising from Your Content, your use of the Service, or your violation of these Terms.

12. Termination

You may stop using the Service at any time. We reserve the right to suspend or terminate your account, with or without notice, for any conduct that we determine violates these Terms or is harmful to other users, us, or third parties.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Texas.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the Effective Date above. Continued use of the Service after changes constitutes your acceptance of the revised Terms.
